Obama Admin Shifting Defense Strategy on Health Care, Stepping Up Propaganda:
The Obama administration is shifting its strategy of defending ObamaCare before the Supreme Court, only days before oral arguments are set to begin. According to The Hill, they will argue that the law is constitutional under the Necessary and Proper clause.
Some legal experts say the shift could steer the case in a direction that would make Justice Antonin Scalia more likely to uphold the healthcare law’s mandate requiring individuals to purchase health insurance.
Oral arguments are set to begin March 26, and the justices are expected to give a ruling in June, just months before the presidential election.
A ruling that the mandate is unconstitutional could make it nearly impossible to implement other parts of the healthcare law — which is exactly the point the Department of Justice is highlighting in its most recent briefs.
Justice has aggressively defended the mandate as its own regulation of economic activity, but is now stepping up a separate argument emphasizing that the mandate is part of a broader regulatory scheme.
The shift moves the focus of Justice’s argument from the Commerce Clause of the Constitution to the Necessary and Proper Clause, which says Congress can make laws that are necessary for carrying out its other powers. (Read More)
Either they’re really nervous, or this new strategy was in the works all along, and they’re only announcing it now to throw off the plaintiff’s attorneys.
The shift in defense strategy isn’t the only thing the administration has been up to. They’re also stepping up the propaganda in an effort to garner public support for the law that is estimated will make 20 million people lose their employer covered health insurance.
This week, The Heritage Foundation’s Rob Bluey obtained a four-page strategy memo that outlines a White House-coordinated campaign to force an unwilling public to accept Obamacare. Once again, all the strategies by the Administration and its liberal allies involve how better to message this hated law as the anniversary of its passage approaches and the Supreme Court hears oral arguments on its constitutionality. If only the Administration put this much effort into lowering the price of gas or creating jobs.
The memo identifies the White House’s target audience — seniors, women, and young adults — with a goal of “increas[ing] overall public support for the law by making the benefits of the law (and consequences of taking those benefits away) tangible by featuring stories of real people impacted.” (Read More)
No doubt they won’t mention how many people could lose their insurance and be forced into government plans.
